The Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (Can-Spam Act) went into effect January 1st, 2004 and is the primary legislation governing spam. The CAN-SPAM Act outlines the rules that commercial email must follow to be in compliance with current law. The CAN-SPAM Act's provisions ban false or misleading header information, prohibit deceptive subject lines, and require an opt-out method in every email, that commercial email be identified as an advertisement, and the inclusion of the sender's valid physical postal address.
